I realize there isn't a pertinent case before the court at this moment, but I would like to see some advisory statement from Roberts addressed to our military, anticipating the possibility of illegal orders from the CIC. It should probably also address State National Guards and Governors as well. I don't think it would have to get deep into the UCMJ. Just kind of a "Pre-Nuremberg Warning" so that our children and grandchildren won't have to scrounge up a shit-ton of piano wire.
I'm frankly disgusted and terrified by what we saw out of the Oval Office yesterday. The disdain for the Constitution and rule of law is obvious and dangerous.
Are there any mechanisms in place to enforce the ruling of the Courts at this point? Or would any rebuke by Justice Roberts simply be words and principles? He should speak up regardless obviously but I'm just trying to understand what might happen here.
It's a good question. The only real check Trump fears is impeachment, and so long as numbers are on his side he's not too fearful of it. But the more he runs foul of the law, and the more he defies the courts, the more he makes the public case it's justified. The Supreme Court can box him in this way with bright line rulings but haven't really yet.
Agreed. However, the more the Supreme Court underscores Trump has broken the law and committed high crimes, and acts in defiance, te more his support will erode. Trump isn't up for election again, so... maybe? Long story short, they can handcuff and restrict him and make it difficult.
I'm hoping the way Trump embarrassed the Chief Justice at the Not the State of the Union brings it home to Roberts, C.J. that Trump is 𝘯𝘰𝘵 his friend, in fact is a clear and present danger to the rule of law and the Constitution and clearly a threat to the independence of the judiciary and Article III.
Good letter -- thanks PurpleAmerica.

Thanks for the response - impeachment unfortunately doesn't seem remotely likely given the makeup of Congress right now.
Sorry I'm not trying to be bleak here - the reality of the current moment is just chilling and sobering.
Praying to see some backbone from the courts this time.

I had to do a double take on the name at first. :)
